From the Era Orientation to the Institutional Response: The Basic Logic of the Construction of Sports Rule of Law in China During the 15th Five-Year Plan Period

The 15th Five-Year Plan period is a key period for China's rule of law in sports to move from a basic formation to a complete science, so we should follow the basic logic of discovering, analyzing and solving problems to promote the construction of the rule of law in sports. At this historical point, the construction of the rule of law in sports needs to closely focus on the era positioning of connecting the past and the future, being scientific and orderly, and achieving paradigm shift. However, at present, the construction in the period still faces such practical difficulties as the incomplete system of sports legal norms, the imperfect mechanism of sports administrative law enforcement, the imperfect mechanism of diversified sports dispute resolution, and the insufficient publicity and education. Therefore, the construction of the rule of law in sports should focus on the core of the Sports Law to promote the legislative work in a planned way, and promote the system of sports legal norms to be more complete and orderly. And, we should adhere to the principle of inclusive and prudent regulation to push the sports administrative law enforcement mechanism to be more scientific and efficient. The sports arbitration system should be comprehensively improved to realize the effective connection between the internal dispute resolution mechanism of sports organizations and justice system. The construction of sports mediation system should be explored to build a diversified sports dispute resolution mechanism. The ways and means of publicity and education on the rule of law in sports should be innovated to fully implement the responsibility system for popularizing the law in sports. The scope of popularizing the law in sports should be expanded to develop the discipline of sports law, thus to promote the training of sports law talents.
