Internal Dispute Resolution System of Chinese FootballAssociation in the Process of Rule of Law: Progress and Problem

The rule of law in the inner governance of Chinese Football Association is a good example among various Chinese sports associations. There are still some problems to be improved in the relevant dispute resolution system. The present dispute resolution rules of Chinese Football Association have much room to improve in the aspects of the extent of jurisdiction, arbitration application, acceptance and reply of arbitration, composition of arbitral tribunal, way of trial, rules of proof, and arbitral decision, etc. Certainly the dispute resolution system of Chinese Football Association has two good spots in terms of rule of law:one is the preliminary difference of national rule of law and industrial autonomy; the other is the initial separation of judicial power and administrative power. But the weak points are also obvious, including the lack of outer supervision system, the shortage of inner relief system and the limited independence of arbitral body. The suggestions are offered as follows:revising the outdated Work Rules of Arbitration Commission of Chinese Football Association, completing and adding the rules related to inner arbitration rules, improving the independence of arbitration commission while eliminating administrative intervention, increase the role of mediation system, and completing the inner relief system as well as outer supervision system.
