Abstract:
Modern biotechnology is widely used in sports events, making athletes' biometric information absorbed, collected and shared more easily, meanwhile more vulnerable to wide infringement. Different from general personal information, its generation is closely related to the personality of the information subject and has a strong personality attribute. Once violated, it will be difficult to remedy and persist forever, and needs special legal protection, therefore a two-dimensional protection model is to be shaped by combining legal interest dimension and time dimension. As to the former, the legal interest properties of an athlete's biometric data should be screened to construct the protection pattern with the legal interests for sport. On the part of time dimension, an athlete's biometric data at different stages should be stressed to integrate the existing legal system with doctrinal methodology to achieve the accurate regulation of each stage. Through the horizontal positioning of legal interest dimension and vertical positioning of time dimension, a comprehensive protection model for athlete biometric information is thus constructed.
